[TRANS] 091112 Three Members Ignored SM Deadline, Both Parties Stood Their Ground

Today is the last day for SM Entertainment and the three members to come to a decision. However, both parties have still failed to do so.

The three members of TVXQ (Xiah Junsu, Micky Yoochun and Youngwoong Jaejoong) and SM Entertainment have still not come to a decision. Both sides are standing strong with their choices, not giving in to the other. Thus, the possibility of them reconciling is decreasing each day. Recently during a press conference, SM has requested the three members to come to a decision by the 12th. However, even though the 12th has passed, there is still no news and this has made fans very worried.

On the 12th, SM Entertainment and the three members of TVXQ did not release any statements; both are still not giving in to the other party. We’re afraid that we cannot anticipate SM Entertainment and the three reconciling.

Regarding the stand of the three members, their representative lawyer from the Sejong Law Firm stated, "Other than those that had already been said, there are no other new updates.” SM Entertainment also said on this day, "We have not received the reply of the three members, meaning that they are not yet ready to officially make a stand."

In the end, there was still no decision made on the 12th and TVXQ's activities may now have problems. In this situation, fans hope that TVXQ can be reunited. The fans said, “We hope that both parties can give in a little, so that we can once again see the future of TVXQ." An anonymous person from the entertainment industry said, "TVXQ is Korea's representative."
"Abandoning the stands of the singer and the company, I hope there will be a good ending to this, for the sake of Korea."

SM Entertainment’s CEO Kim Young Min stated during a press conference, held on the second of November, that “In 2002, 2007, 2008, the company under the correct and impartial advice of the Exchange Commission had amended the exclusive contract damages and it had contained the time of the contract and also the contents" "Yet, after such an amendment of the contract, it had been described as ‘slave contract'"

But there were raised objections regarding the statement, "After three revisions of the contract yet it was still like this, then we could imagine how badly this contract was previously."

After the press meeting, a fan stated, "The nature of this incident is obviously unfair and an inappropriate treatment, SM has always been ambiguous” "How could they really believe that today's contract is legitimate and conventional?"

The new representative for the cultural development, Kim Myeong-Sin expressed his own views regarding this confusion, "There’s a need for respecting the artist and also the efforts from the company to clean its own name," "For the sake of our performing arts and cultural development to go further, it is required from the company's own efforts to develop a better contract, as well as practices and protocols."

Representative Kim stated “Such a large company like SM acts as the precursor for our country’s cultures." "I hope to see the industry recognize a real sense of responsibility, and to strive for reasonable contract practices and performing arts industry aiming for a common development."

Representative Kim also added "The entertainment industry should not treat this lawsuit as a legal dispute between artists and the company; it should be treated as a fight for the rights of the artists and the establishment of a reasonable distribution of income in a contractual relationship with a transparent structure and other advanced management system opportunity."

There were also people who expressed that with the complains that had emerged from the society, both the company and the artists are not gaining anything, they should work together to find the solutions regarding this matter.

Professor Lee Dong-Nyeon stated, "The company should not look at their artists from the perspective of goods or capital, but as collaborators and companions, artists should also be conscious that they should seek for the short-term self-interest and generate them into something which promotes the cultures."

[NEWS] 091106 Unfair Contract Dispute, SM has changed its Stand?

SM Entertainment CEO’s Kim Young Min, who is involved in the ‘unfair contract’ dispute with his artistes, has recently announced a new contract policy, and that it will be put into action once it gets approved by the related authorities.

SM Entertainment representative, Kim Young Min, who attended the press conference which was held on the 2nd of November 2009 at 63 Tower, has expressed, “We would collect all comments from music and entertainment industries, related government departments, cultural and tourism board, fair trade departments, educational circles and legislative bodies, based on the law to adjudicate a new contract policy. After the approval from the respective authorities, we would then put it into action. Then follow it (new contract policy) enthusiastically.”


Kim agreed, “If we are able to come out with a new exclusive contract policy based on the law, SM would like to re-contract with all current artistes based on it.”

Kim also expressed, “Under the new exclusive contract, the moment it’s signed it would be protected till the contract ended, if not the current situation would repeat over and over again in the future.”
“In order to prove that what have just I said is nothing but the truth, we would first like to take the advice from the impartial committee,” he said.

But, everyone was not able to fully believe this announcement by SM Entertainment. Professor Lee from Korea Art University stated, “If SM do not wish to have what they have just said to turned into nothing, then they should assure them.” He continued, “Based on what SM have said, they do not wish to fully take on the advice from the impartial committee, but to forcefully come out with a new contract policy, which was questionable (their announcement).”

Professor Lee ended, “If SM was really sincere about this, they should work on the new contract based on the advice and not vice versa, and then to get it approved by the representative authorities.”

[TRANS] 091104 Mnet Secret - "The Miracle of Tohoshinki"

Like a music sheet…



T/N: In Japanese, a music sheet is written as gosenshi, which literally means a paper with 5 lines. In this post, the author refers the 5 lines of the music sheet to the 5 members of Tohoshinki.

I was going to write something on the second day of Saitama, but I think everyone is now confused and worried about what’s going on with the contract dispute after the news came out on 11/2.

A few days ago, after the partial decision of the lawsuit came out, SM Entertainment hold an interview. As for this interview, each person had each own understanding and judgment, thus each report came out with different information. I am not here to make any comment regarding this matter.

Only when the 5 of them are together are they called Tohoshinki. Tohoshinki is a group that its members keep on moving forward with the unshaken emotions that they want to protect. Even now when the members have different standpoints, I believe that the road that they’re heading to is the same.

Do you know the B-side song of the single “Lovin’ You” that is called “Gosenshi” (五線紙 – music sheet)? Yoochun once said, “When I listened to this song, I thought of Junsu’s smile.”

Yoochun does love Junsu a lot, doesn’t he? Even though this song is a little bit simple, it is a really heart-warming song with hidden meanings. When you listen to this song, you will be able to see the image of the 5 of them heading towards their dream together. This song was written by H.U.B., who is also the lyricist of “COLORS ~Melody and Harmony~”. I am sure that he always thought of Tohoshinki and used them as reference when he wrote the lyrics.

[NEWS] 091102 SM is Sure of Overruling Court's Decision on TVXQ

Talent powerhouse SM Entertainment has vowed to fight back and win against a court ruling last week which granted three members of boy band TVXQ partial victory in their request to nullify their exclusive contract with the agency.

In late July, TVXQ members Hero Jaejoong, Micky Yoochun and Xiah Junsu had applied for provisional disposition of their 13-year contract with SM to which a court ruled that the agency will not interfere in their individual activities.

"The recent decision has not taken the essential reasons and fundamental of the issue in to consideration," SM started by saying in a press release on Monday. "We are sure that the court's decision will change once we provide enough evidence which are looked into under the proper legal proceedings."

SM also declared that they will ask the three for compensation amounting to over a total 2.5 million dollars for the losses and damage incurred upon the group and the agency with the ongoing legal action, should the court rule in favor of SM in its final verdict.

They went on to explain that the terms of the contracts had been adjusted every year in favor of the members and are now asking to be freed from them since they are starting to see success.

"This ruling will cause confusion in the entire entertainment industry and make it impossible to create a system where (agencies) will be able to upbring their stars with long-term prospects," SM added.

The statement came just hours before a news conference set for later in the day where they plan to talk about their position in more detail.

TVXQ, who debuted in 2004 with album "Hug", is one of Korea's most successful K-pop groups. They are stars throughout Asia, reportedly having the largest fanbase in the world, and have enjoyed great success in the Japanese music industry in particular.

[TRANS] 091028 Cassiopeia Frees TVXQ's 'Chains' ...A Fandom's Victory


On the 27th, the Seoul District Courts' partially acceptance of the exclusive contract suspension request submitted by three members of TVXQ, YoungWoong Jaejoong, Micky Yoochun and Xiah Junsu, could be seen as a 'victory' of the fans.

At the end of July, when YoungWoong Jaejoong, Micky Yoochun and Xiah Junsu filed the dispute to the Seoul District Courts, Cassiopeia rose up as strong 'supporters' by criticizing and highlighting every single unlawful clause in the exclusive contract that gave the agency the upper hand.

The support given by the fans of TVXQ are somewhat different from the actions of those of previous idol groups. First, instead of engaging in emotional, group activities against the agency, they are acting in a efficient, sensible way by informing society of the unlawfulness of the contract.

On August 14th, at the Korean Cultural University's debate 'Problems and Solutions to the entertainment management system through the TVXQ situation', Kim Euna stated, "If you look at the schedule of TVXQ that the fans put together, the amount of work that TVXQ has been put through ever since they debuted is an incomprehensible amount," and "Please don't see this dispute as a mere fight for money, but a fight to protect human rights."

Fans also walked to the streets. The petition that began online and offline on August 26th gathered signatures from 188,000 people who were against the unlawful contract system that was rampant in the nation.

Fans submitted a petition to the Seoul District Courts who was in charge of the case to act as witnesses for the unlawful act put upon minors by the agency under the name 'People who are against SM's unlawful contract.' In this petition, they stated, "Please put an end to contracts that chain celebrities and puts them at a unfavorable, unequal position."

Their voices have risen towards national organizations as well.

They submitted another petition to the National Human Rights Commission saying, "In the case of celebrity exclusive contracts, they are not contracts for the trade or sale of objects, but for human talents and work which means that the basic human rights must be protected before anything else. Therefore, the National Human Rights Commission must lend a helping hand in this issue of the unlawful contract so that it does not violate the human rights of the members."




They also visited the Fair Trade Committee and filed a complaint against SM Entertainment's unlawful trade using the exclusive contract saying, "SM Entertainment abused its power and involved TVXQ in an unlawful trade."

They also filed for a Compensation request against SM to the Korea Consumer Agency when the agency indefinitely postponed the 'SM TOWN LIVE 09' concert in August. The fans stated, "This is not a problem between fans and an agency, but a problem between consumers and sellers," and said, "We are not merely asking for compensation because we want our money back, we are filing this because we cannot sit back and let a company tyrannically attempt to take control over us and we wish to get back our rights as consumers."

Recently, the fans criticized the Korean Youth Committee's action of giving CEO Kim Young Min an 'Order of Merit for Teenagers' for "Supporting the growth of the teenager culture" by saying, "By giving Kim Young Min this order of merit during the waiting period for the verdict, the Korean Youth Committee is giving up its neutral position in the trial and taking sides on the issue."

The movement of fans did not stop at the Korean border. Fans from 40 countries around the world collaborated on YouTube by writing messages of support to TVXQ; all connected by the love for the group. Japanese fan club 'Bigeast' showed their unwavering love for TVXQ by collecting 1000 messages of support.

As the fans' voices rise, politics began to move as well. The TVXQ dispute has become a 'hot potato' at the National Assembly.

At the National Assembly's inspection of the Department of Culture, Sports and Tourism, many officials said, "Many entertainment agencies are putting unlawful pressure and orders against their celebrities and have gotten to the point where they violate human rights," and put forth TVXQ's 'slave contract' as the main example.

At the National Assembly's inspection of the Fair Trade Committee, official An Young Ho talked of the problem of Exclusive Contract Lengths which came up due to TVXQ's exclusive contract suspension request and stated, "We are seriously investigating the problem of TVXQ's unlawful contract as a complaint has been made," and "There is a problem with the length of 13 years."

Whenever fans got involved, they stated, "If we leave things as they are, the 'bad root' of the entertainment business will continue to grow," and "We must correct this activity as soon as possible to ensure that another TVXQ does not come about."

YoungWoong Jaejoong, Micky Yoochun and Xiah Junsu thanked these fans right after the Courts' decision was revealed.

Through their legal representative, they stated, "We would like to sincerely thank the fans for their unwavering trust and support," and "We will repay the Courts' decision to free us from the unlawful exclusive contract and allow us to pursue individual activities by striving to become unique true artistes."

TVXQ fans are still holding a boycott against SM Entertainment. They are still striving to receive their compensation from the Korea Consumer Agency. Although the Courts have made their decision, it seems as though the fans will not stop their actions against the agency. In fact, these actions may not cease until the lawsuits of the exclusive contract and income division end. They don't seem to be slowing down anytime soon.
