[TRANS] 100917 Interview With Trio's Legal Spokesman Lawyer Lim Sang Hyuk

In an interview on the 17th, the trio's legal spokesman and lawyer Lim Sang Hyuk revealed that, "Avex requested changes in the contract that the members found difficult to agree to in clauses regarding topics such as income distribution."

Lawyer Lim Sang Hyuk also added, "At first, it was agreed that all activities performed by the three members would be scheduled and discussed by both sides, but Avex began asking for this to be changed so that Avex would have sole control of scheduling; Avex also requested additional changes that the trio felt were logically unacceptable"

Regarding Avex pinpointing the history of the head of C-JeS as the main reason for halting activities, Lawyer Lim explained that, "Mr. Baek, the head of C-JeS, willingly volunteered for his company to be excluded from the contract if his criminal record would become a problem, but Avex ignored such a notice," and "Later, they deemed that it would be difficult to progress normally with Mr. Baek's background."

The TVXQ trio's official statement said that, "Several months ago, Avex requested that C-JeS be excluded from the contract for such reasons, and the TVXQ trio agreed to such a request and actively participated in the discussions regarding the renewal of their contract with Avex in order to ensure that they would have smooth activities within Japan."

Lawyer Lim stated, "When viewing the chain of events, there were many situations that could only be seen as Avex insisting that things go their way and their way only. If the opposition decides to retaliate, we will release additional information from our side."

He also added that, "The essence of the current controversy is that an agency offered unfair conditions, contrary to what had been included in the previous contract, to their artistes. When these artistes refused to comply, the agency halted all activities, disregarding the members' wishes," and "It is disheartening to see that Avex is using the head of C-JeS, who is not affiliated with any gangs whatsoever, as a scapegoat to distract the media and public from the real problem."

Lawyer Lim criticized that, "It is immoral to back the TVXQ trio, some of Korea's most representative Hallyu stars, into a corner just because they cannot fulfill a company's greed," and strongly stressed that, "We will work hard to resolve this situation and allow the TVXQ trio to resume their activities in Japan."

[TRANS] 100916 Tohoshinki Trio Halts Activities in Japan

Avex announced on 16 September that Tohoshinki members Jejung, Yuchun and Junsu’s Japanese activities with be suspended until further notice.

Avex expressed that the management company the trio’s management company and legal representative in Korea, C.JeS, has been found guilty of, and sentenced to prison on charges of coercion. As the trio’s lawsuit in Korea with regards to the exclusive contract is still pending, the chances that the exclusive contract is invalid has increased.

Avex stated that until these issues are resolved, they have decided not to continue with the management of the artists’ activities in Japan. The trio, for the time being, have decided to halt all activities.

[TRANS] 100629 Daewoo Says SM Possesses At Least 50 Billion Won In Cash.. The Lawsuit Is Not A Problem

Daewoo Securities Co. Ltd. stated on the 29th that although SM's stocks (041510) (12,950 Won, -3.00%) are plummeting due to the TVXQ lawsuit issue, the dip is nothing to greatly worry about.

Kim Chang Won of Daewoo Securities Co. Ltd. Research Center stated, "The current situation is a good opportunity to buy," and "SM has at least 50 billion Won in cash reserves, so they will be able to easily cover a 3 billion Won compensation lawsuit."

"Their second quarter sales will exceed the ballpark figure," and "In the third quarter, SHINee and BoA's domestic activities, Girls Generation's Japanese activities and Super Junior M's Chinese activities will reap great rewards."

[TRANS] 100628 TVXQ's Trio 'SM should pay 30 billion won'

Idol group TVXQ's Trio have filed a lawsuit against SM Entertainment to terminate the effectiveness of their exclusive contract.

According to Seoul District Courts on 28th, Hero Jaejoong (kim Jaejoong), Xiah Junsu (Kim Junsu), Micky Yoochun (Park Yoochun) stated that, 'SM advocates that in order to expand the overseas market, 13 years of contract is a must. However, it is unreasonable and non understandable.', 'Even the contract can be terminated, members still need to pay compensation fee for the damage, the amount is too big and unreasonable.'

Three of them stated that, 'Since the exclusive contract is invalid, so SM should consider TVXQ's income as unreasonable income, ' SM must first pay each member 10 billion won, with a total of 30 billion won'. and advocated that, ' From 60 billion won TVXQ has earned till now, SM must pay each member 10 billion won ultimately after divided the total income and minus the additional cost.'


They submitted 'near life-long exclusive contract suspension injunction' to court in July last year. In October the same year, the court decided to invalidate their exclusive contract, and stated that 'Before a judgment has reached in this case, SM cannot hinder the trio's solo activities.'

[TRANS] 100628 TVXQ Trio File Lawsuit For Exclusive Contract

Three members of 'TVXQ' have filed a lawsuit against SM Entertainment following their exclusive contract injunction.

According to the Seoul District Courts, Xiah Junsu (Kim Junsu), Micky Yoochun (Park Yoochun) and YoungWoong Jaejoong (Kim Jaejoong) filed an exclusive contract validity suspension lawsuit on the 25th.

Sejong, the law firm in charge of the trio's legal actions, stated, "The exclusive contract period is thirteen years from the date they debuted, however, if military service is taken into consideration, the length of the contract is in fact fifteen years," and "This violates Clause 103 of the civil code." Clause 103 of the civil code states that any legal acts that violate good customs or public order will become invalid. Sejong also stated, "If the contract is canceled, the members must pay an extravagant compensation fee that is three times the amount of total investments and twice the amount of what the group would have earned in the remaining period of the contract."

The trio submitted an exclusive contract suspension injunction last July which was partially granted in October. SM Entertainment also filed an objection to the partial acceptance verdict and a lawsuit to confirm the continued validity of the exclusive contract in April.

[NEWS] 100520 Dong Bang Shin Ki trio’s new group name ‘J.Y.J’?

Ahead of their Japanese fanmeeting concert coming June, it is known that Dong Bang Shin Ki Xiah JunSu, Micky YooChun and Hero JaeJoong will promote under the nickname of ‘J.Y.J’.

Previously an official announcement came that the group will discontinue their activities as Dong Bang Shin Ki after the 3 members’ discord with their agency SM Entertainment. And coming 5th June, the 3 members will hold a large scale fanmeeting concert in Tokyo Dome, and they will be holding the concert as ‘J.Y.J’ made up of the initials of each of the members.

A representative of the 3 members revealed on 19th May, “Ahead of their event, AVEX has decided to go with ‘J.Y.J’ for the logo for the concert. Even though they will promote as J.Y.J for the concert, it is not their confirmed group name. We will not know the group name until AVEX releases an official announcement.”
